Renouncing an Inheritance: Deadline, Consequences and Insolvent Estates

An heir can renounce an inheritance, but the time limit is short: 3 months from the date they learn the inheritance has passed to them.

Short answer: An heir can renounce an inheritance. The renunciation period is 3 months from the date they learn the inheritance has passed to them, and this period is a forfeiture period (TMK art. 606). If the period is missed, the heir may be deemed to have accepted the inheritance.

Consequence of renunciation

A person who renounces an inheritance loses the status of heir with respect to that estate; the renunciation may pass to their descendants in their place. In indebted estates, an heir may prefer renunciation to be free of the debts.

Renunciation by operation of law

If it is clear that the estate is insolvent, a separate situation arises, renunciation by operation of law (hükmen ret); in this case there is no time limit and the court decides of its own motion.

Steps

  1. A written application to the civil court of peace.
  2. The petition contains the heir's details and the declaration of renunciation.
  3. The decision becomes final by the court's ruling.
