What Happens If the Tenant Leaves Before the Term Ends? Early Departure and Termination

In fixed-term leases, a tenant who leaves early may have to pay rent until a new tenant is found or until the end of the term.

Short answer: In a fixed-term lease, if the tenant vacates before the term ends, the contract as a rule does not end. The tenant may remain liable for the rent until a new tenant who can use the property within a reasonable time is found, or until the end of the term (TBK art. 325).

What options are there?

  1. Finding a new tenant: If the tenant proposes to the landlord a new tenant who is solvent and ready to rent, the liability may end.
  2. Mutual agreement: The parties can end the contract in writing.
  3. Just cause: If the property is unfit for use or there is serious fault, the tenant may exercise a right of termination.
  4. Penalty clause: If the contract sets an early-departure fee, the judge may reduce the amount.

Points to note

  • The termination notice must be in writing.
  • The handing over of keys must be documented with a record.
  • For the return of the deposit, the handover record is important.
