Can the Buyer of a Home Evict the Tenant Immediately?
A sale does not automatically end a lease. The new owner must continue the contract; they have only a limited, short-term right of need.

Short answer: A person who buys a rented home becomes a party to the existing lease and must comply with the contract. Buying alone is not a sufficient reason to evict the tenant.
The tenant is protected
The sale or transfer of the rented property does not end the lease. The new owner is bound by the rent, term and other conditions in the contract. So an investor who wants to buy a rented home should examine the lease and the tenant and decide accordingly.
The new owner's right of need
If the new owner genuinely needs the home for themselves, their spouse, descendants, ascendants or persons they are obliged to support, they may end the contract by written notice to the tenant under TBK art. 351. This right is limited to very short periods after acquisition and the need must be proven. Get legal advice before buying so as not to miss the deadlines.

Checklist as a buyer
- Review the lease, the rent and the term.
- Clarify who holds the deposit and whether it is kept in a bank.
- Ask about the tenant's payment history and any eviction undertaking.
- Add to the sale contract a statement on the accuracy of the tenant information.

Frequently asked questions
Can the new owner raise the rent?
Rent increases are determined under TBK art. 344; buying alone does not give a right to increase. For details, see our article rent increase rate.
Does the deposit pass to the new owner?
To whom and how the deposit is transferred should be clearly written in the sale contract.
Will the tenant want to see the home during the sale?
While the tenancy continues, the home cannot be entered without the tenant's consent; agree on viewings in advance.
