Eviction for Own Need: When the Landlord Wants to Move Back In

Short answer: A landlord may end the tenancy if they, their spouse, descendants, ascendants or persons they are legally obliged to support need the home (TBK art. 350). The need must be genuine and sincere; the court requires proof.

Conditions

• Person in need: It must be the landlord, their spouse, children, parents or a person they are obliged to support.
• Genuineness: The need must be serious and credible for an eviction order to be granted. The existence of another suitable home can weaken the sincerity of the need.
• Time limit: For fixed-term contracts the lawsuit is filed within 1 month after the end of the lease term. For open-ended contracts, the lawsuit is filed at the end of the rental period, respecting the termination notice periods.

Re-letting the home after eviction

If a home vacated for own need is let to someone else within 3 years without a justified reason, the sincerity of the need is called into question. The former tenant may claim compensation of at least one year's rent (TBK art. 355).
