How Is the Rent Increase Rate Calculated? The 12-Month CPI Average Rule

In renewed rental periods the increase cannot exceed the 12-month CPI average. How do you calculate it and where do you find the TurkStat data?

Short answer: In a renewed rental period, the rent increase cannot exceed the change rate of the 12-month average of the CPI announced by TurkStat (TBK art. 344). If the contract states a lower rate, that applies; even if a higher rate is written, the upper limit is the CPI average.

How is it calculated?

  1. Find the 12-month average CPI change rate on TurkStat's website (the value for the month in which the increase will apply).
  2. Multiply the current monthly rent by this rate.
  3. The resulting amount is the highest rent for the new period.

For example, if the rent is 20,000 ₺ and the 12-month average rate in the relevant month is 30 percent, the upper limit is 26,000 ₺. The figures are only an example; check TurkStat for the current rate.

The 2024 change

The temporary limits applied in the earlier period ended in July 2024. For periods renewed from that date, the increase is made under the general rule in TBK art. 344.

After five years

When the contract exceeds five years or is renewed after five years, the judge sets the rent fairly, also taking comparable rents into account. In this case, the "increase by CPI" rule alone is not sufficient.

Rent in foreign currency

Between persons resident in Turkey, residential rent must be set in Turkish lira. For details, see our article how a rental contract is prepared and consult a lawyer for the current rules.

Frequently asked questions

Can I write any rent I want for a new tenant?

In a new contract the rent depends on the parties' agreement; TBK art. 344 limits renewed periods.

What if the contract has no increase clause?

The increase is agreed by the parties within the TBK art. 344 limit; if there is no agreement, the court can be asked to determine the rent.

What if the tenant does not pay an excessive increase?

Since an excessive increase is invalid, the tenant is not in default for the part they did not pay; however, a wrong calculation leads to disputes.
