What Happens When a Rental Contract Ends? Automatic Renewal and Notice of Departure

A fixed-term rental contract is extended for a year on the same terms if the parties give no notice in time. The tenant may give notice at least 15 days before the end of the term.

Short answer: In a fixed-term residential lease, if no one gives notice at the end of the term, the contract is extended for one year on the same terms. The tenant can end the contract by giving written notice at least 15 days before the end of the lease term (TBK art. 347).

For the tenant

  • If you want to leave, give written notice at least 15 days before the end of the term; otherwise the contract is extended for another year.
  • If you want to stay, no separate step is needed; however, the rent increase limit applies.

For the landlord

If the landlord wants to prevent the renewal, they must rely on a legal ground for eviction: such as need, an eviction undertaking or the ten-year rule. For details, see our article how to evict a tenant.
