What Is Developer Consent (Muvafakat)? Is Approval Needed to Transfer a Project Apartment?
Muvafakat is the developer's approval of the transfer. If the contract requires it, an assignment alone may not be enough without approval.

Short answer: Muvafakat is a party's written approval of a transaction. When the rights to an apartment bought in a project are transferred, the developer's written consent is required if the contract says so; without approval, the transfer may not be enforceable against the developer.
Why is it required?
The developer is bound to the buyer in terms of the payment plan and delivery obligations. When the buyer changes, who makes the payments and how changes. For this reason, transfer contracts often contain these clauses:
- Developer approval for a change of buyer.
- Payment of the transfer price and remaining debts.
- The new buyer's identity and tax details.
What should the consent state?
- Parties. The previous and new buyer, and the developer.
- Apartment details. Block, floor, unit number.
- Payment status. The amount paid so far and the remaining amount.
- Assignee's responsibility. Remaining payments and delivery conditions.
- Date and signature. An authorised signature; for a company, a document proving authority.

Frequently asked questions
Can the developer refuse consent?
If the contract has a condition, the developer may withhold approval. Whether the reason is reasonable is assessed under the contract and the law.
Is the consent paid for?
The contract may include a transfer fee or commission; it must be in writing.
Is consent also needed at the title transfer?
A different procedure applies at the title transfer stage. For details, see our article notarial assignment.
