What Is a Notarial Assignment? How to Transfer Rights in a Project Sale
A notarial assignment is the transfer of the rights arising from the contract by a person who bought an apartment in a project. The developer's consent and the payment status are decisive.

Short answer: A notarial assignment (temlik, or temlikname) is when a person who bought an apartment in a project transfers the rights arising from the contract to a new buyer by a document drawn up at a notary. Ownership does not pass at this stage; the new buyer takes over the right to demand transfer of the title.
How does it work?
- The existing contract is reviewed. The sales promise contract and the payment plan are checked.
- Developer consent is obtained. Depending on the contract, written consent may be required for the transfer. For details, see our article what is consent (muvafakat).
- The payment status is clarified. The amount paid, remaining instalments and the account reconciliation are written down.
- The assignment is drawn up at a notary. The transfer, the price and the scope of the rights transferred are written.
- Handover and title deed. When the project is finished, the new buyer requests the title deed in their own name.

Points to note
- Transfer ban. The contract may include a developer-consent requirement or a ban on transfer.
- Debt and mortgage. Are there annotations on the plot or the unit?
- Tax and costs. For notary costs and possible tax consequences of the assignment, consult an accountant.
- It is not a title transfer. Without a title deed, a home loan and some citizenship procedures may be limited.
Frequently asked questions
Are an assignment and a sale the same thing?
No. A sale is a transfer of title; an assignment is the transfer of rights arising from the contract.
Does the new buyer make a new contract with the developer?
It depends on the contract. Often the record is updated with the developer's consent and the new buyer's identity details.
What provides security in an assignment?
Drawing it up at a notary, payment documents and the developer's consent. For details, see our article buying in a project without a title deed.
