Eviction Undertaking at a Notary: Is Notarisation Required?

An eviction undertaking at a notary is not mandatory, but it reduces objections about date and signature. When, how and with which documents is it done?

Short answer: Having an eviction undertaking drawn up at a notary is not a legal requirement. However, notarial certification provides strong proof that the document's date and signature belong to the tenant.

What does a notary provide?

  • Certainty of date: The notary officially records the date on which the document was drawn up. This weakens an objection that "the date was written later."
  • Identity verification: The tenant's identity and signature are verified at the notary.
  • Clarity of intent: The notary reads the text to the parties; a tenant will struggle to claim duress.

These benefits do not automatically guarantee the validity of the document's content. The undertaking must still be given after the tenancy is established, with a clear date.

How is it done at a notary?

  1. The parties' identity documents are prepared.
  2. The rental contract and the property's address details are brought.
  3. The promised vacating date is written as day, month and year.
  4. The tenant signs in front of the notary. Appearing in person is preferable to using a proxy.
  5. Two copies of the document are made; one stays with the landlord.

Notary fees are updated every year; check with notaries or the Union of Turkish Notaries for the current tariff.

Deadline after the undertaking

If the tenant does not leave on the stated date, the landlord must start enforcement proceedings or file a lawsuit within 1 month. Notarisation does not extend this period.

Frequently asked questions

Can a notarised undertaking be made on the same day as the rental contract?

Taking it on the same day may raise the question of invalidity. As a rule, the undertaking is taken after the tenancy is established.

What if the tenant refuses to sign at the notary?

Giving an undertaking depends on the tenant's free will. If they do not sign, the landlord looks into other legal routes for eviction (own need, warnings, end of term).

Does doing it at a notary win the case in court?

It does not guarantee it, but it eases the burden of proof. For details, see our article what is an eviction undertaking.
